What your claim can include

How long you have
Two years from the date of death for most claims. Six months to file a government claim if a public agency, vehicle or road condition was involved. Where a crime was committed, the criminal case and the civil claim run separately.
Good to know
- Who can bring the claim.
- The surviving spouse or registered domestic partner, the children, and if there are none, others who would inherit. Financially dependent stepchildren and parents may also qualify. We’ll walk through it with you.
- Criminal charges are not required.
- A civil claim stands on its own and has a lower standard of proof. A driver acquitted, or never charged, can still be found responsible for a death.
